Chapter-1
Scope of Work: - Supply of medicines and surgical items for the dispensary of Model Jail, Chandigarh. The
Jail Department, U.T., Chandigarh is having a Dispensary inside the Jail for providing treatment to the prisoners of the Jail for which there is urgent need to purchase medicines to be used in the said Dispensary. This tender document has been made to purchase the medicines to be used for the Jail Dispensary on the terms & conditions mentioned there. TENDER NOTICE
Sealed tenders here by invited from the reputed firms for the purchase of medicines approximately Rs. 9.75 Lakh for the Jail Dispensary. The tender duly completed in all respect should reach in the office of Superintendent Jail on or before 27.01.14 upto 2.00 P.M. along with earnest money amounting Rs. 30,000/- in the shape of DD in favour of Superintendent Model Jail, Chandigarh. Tenders will be opened on the same day placed at 4.00 P.M. by the committee in the presence of Tenderers or their representatives who may wish to be present to witness the opening of the tender. The tender document along with terms and conditions can be downloaded from the website (www.chandigarh.gov.in/tenders.gov.in) in the tender India website. Chapter-2
Terms and Conditions
Incomplete, conditional, telegraphic or tenders received late or without earnest money will not be entertained. The applicant shall submit the tender on the prescribed format which can be downloaded from the website (www.chandigarh.gov.in/tenders.gov.in). Successful bidder has to sign the terms and conditions of the contract and to deposit performance guarantee @5% of the value of the supply order in favour of Superintendent Model Jail, Chandigarh within 7 days from the issuance of letter of Acceptance of tender duly pledged by designation in favour of Superintendent Model Jail, Chandigarh. The earnest money will be released after receiving the performance guarantee deposit. Owing to failure on the part of successful tenderers to deposit the performance guarantee within the specified period, the earnest money will be forfeited and the letter of acceptance of the tender will be cancelled without any notice. The committee constituted for the purpose reserves the right to reject all or any tender without assigning any reason. In case of any dispute, the jurisdiction will be at Chandigarh. Certificate to the effect that the firm is not black listed by any Govt. or Autonomous body in the shape of affidavit attested by Notary Public. All corrections in the tender should be properly initialed. The earnest money of the unsuccessful tenderers will be released after the finalization of the tender The lists of medicines are only to show the medicines required for use in the Dispensary of the Model Jail, Chandigarh. Rates of medicines should be Net i.e. including all taxes and excluding discount if any. Rates of the items should be F.O.R. destination. The order of the procurement of medicines will be placed to the successful tenderers according to requirements of medicines. The rates so offered should remain valid for a period of one year from the date of commencement of This contract shall be for one year from the date within 10 days from the actual date of allotment of contract against the tender. The tender with cutting, overwriting and interpolation shall not be accepted. Each page of chapter-2 & chapter-5 of the tender document should be signed by the tenderers with stamp of the firm. The inspection of material will be carried out by the Department Purchase Committee at destination. The successful tenderer shall have to supply the ordered quantity of material strictly according to the approved specifications and no substitute of branded medicines will be accepted at any cost. The successful tenderer shall have to supply the quantity of the medicine according to the supply order within 7 Days after the receipt of supply order. Failing this a penalty of 5% of the amount of the item/s shall be deducted from the bill of the tenderer. If the item/s has not been supplied within 14 days then the item/s will be purchased from market and the difference in the price shall also be Page 3 of 15
charged from the tenderer. If the tenderer/s fails to supply the items at all within 21 days then their performance guarantee will be forfeited and tender will be allotted to next bidder. The tenderer whose total order in doesn't exceed Rs. 10,000/- will not be issued letter of acceptance and his items will be given to the next bidder. If the items (both generic and branded) supplied by the firm are not likely to be consumed then these will be returned to supplier at least prior to 3 months of expiry date and the amount will be deducted The disputes arising out of his contract will be settled at Chandigarh and will be referred to the sole arbitrator of an office to be appointed by the Inspector General of Prisons, U.T. Chandigarh for arbitration. The award of the arbitrator shall be final and binding on both the parties. The tender/s received after schedule date / time and without earnest money will not be accepted at The performance security of the successful tenderers will be released only after the completion of contract period successfully. The Inspector General of Prisons, U.T. Chandigarh reserves the rights to accept or reject the lowest tenders or all the tenders without assigning any reason which in his opinion do not appear to be the best in public interest and no correspondence in this regard will be entertained. Schedule of Requirements:-
1. Offer will be accepted in Two wax sealed envelopes super scribed as "Technical & Financial Bid." "Tender of supply of Medicines for the dispensary of Model Jail, Chandigarh."
A. Financial Bid should consist of signed tender document duly filled, signed by the bidder on every page and price schedule. B. Technical Bid should consist of :- 1. Earnest money in the shape of bank draft amounting to Rs. 30,000/- in favour of Superintendent, Model Jail, Chandigarh. 2. Income Tax Returns of last 2 assessment years. 3. Document showing experience of similar materials of costing Rs. 9.75 Lakh in India in last 2 years from 01.04.11 to 31.03.13. 4. Balance sheets for last 2 assessment years duly audited by the Chartered Accountant. 5. Attested Photocopy of PAN card, VAT No. & CST No. 6. Affidavit to the effect that the firm is not black listed by any Govt. or Autonomous body/Societies/Corporations etc. 7. Name, address/ contact No. of persons signing the tender document and of bidding person or Firm and company. 2. Individual signing the Bid or other documents connected with the contract shall indicate the full name below the signature and must specify whether he is signing as : (a) A sole proprietor of the firm of constituted attorney of sole proprietor. (b) A partner of the firm, in which case he must have the authority to represent for arbitration of disputes concerning the business of the partnership firm either by virtue of the partnership agreement or power of attorney. (c) Constituted attorney of the Firm. (i) In case of (b) above a copy of partnership agreement or general power of Attorney, in either case, attested by a Notary Public, or affidavit on a stamp paper of all the partners admitting execution of the partnership agreement of the General power of attorney should be furnished. (ii) In case of partnership firms, where no authority to refer dispute concerning the Business of the partnership has been conferred on any partner of the firm. A person signing the letter from or any other documents forming the part of the contract on behalf of another shall be deemed to be warranty that he has authority to sign, such documents and if, on enquiry it appears that the person has no authority to do so, I.G. Prisons, Chandigarh may, without prejudice to other civil and criminal remedies, cancel the contract and make or authorize execution of contract/ intended contract at the risk and cost of such person and hold the signatory liable to the I.G. Prisons, Chandigarh for all cost and damages arising from the cancellation of the contract including any loss which the I.G. Prison, Chandigarh may have no account of execution of contract/ Intended Individual signing the contract or other documents connected with the contract shall indicate the full name below the signature and must specify the capacity and authority under which he signs such documents and shall also submit documentary evidence of his authority duly attested by a Notary Public.
